A $150,000 settlement was obtained on behalf of a minor child for injuries resulting from an accident. The minor child was riding on a lawn mower with his father. While they were returning home from helping a neighbor, the riding lawn mower was hit from the rear by a pickup truck. The minor child sustained a broken leg and a concussion. The driver that collided with the riding lawn mower only had minimum coverage limits, $25,000 in liability insurance. His insurer tendered the $25,000 policy limits upon demand. After settlement with the driver was reached, a second claim for underinsured motorist benefits was made upon the parents’ insurer. The underinsured motorist carrier paid $125,000 to settle the minor child’s claim and waived its claim for reimbursement of PIP benefits paid on behalf of the minor child.
As part of a highway expansion in Southwest Kansas, the State of Kansas filed a condemnation action. The State sought to obtain through eminent domain a family farmhouse that was beginning to fall into disrepair. The State initially offered the clients $90,000. After the clients retained Joe as counsel the clients obtained compensation from the State for the property, their relocation expenses and their moving expenses. Total compensation received by the clients was in excess of $250,000.
Our client was riding was a passenger in the car when the driver fell asleep at the wheel. The car went off the road into the ditch and our client sustained serious injuries. We brought a suit against the driver and reached a 6-figure settlement.
A Ford County, Kansas employee filed a complaint with the EEOC alleging age discrimination was occurring in the workplace. Shortly after the employee filed the complaint with the EEOC, he was fired for insubordination. The former employee hired Joseph T. Welsh who filed suit on his behalf in the United States District Court of Kansas. The former employee set forth claims for age discrimination and retaliation against him for filing a complaint with the EEOC. The lawsuit was settled by Ford County before discovery was completed for $110,000.
